Illinois Makes Insane Announcement About Cash Bail

On Monday, history was made as Illinois became the first state to eliminate cash bail. The move, celebrated by Democratic officials, has been met with criticism from law enforcement.
The Illinois Safety, Accountability, Fairness, and Equity-Today Act (SAFE-T Act) officially went into effect, marking the end of cash bail in the state. This means that individuals who have been arrested will no longer be required to pay for their release. Democratic officials argued that cash bail has long been a discriminatory practice that disproportionately impacts minority and low-income communities.
Cook County District Attorney Kim Foxx, who is backed by billionaire philanthropist George Soros, believed that the new law was a step towards a fair and equitable justice system. In a statement, she said, “This bill was a collaborative effort between advocates, victims’ rights groups, and those who have been personally impacted by the injustice of cash bail. We have seen cases where individuals with financial means were able to buy their way out of jail and continue to cause harm. Removing this barrier will ensure that those who pose a real threat to our society are detained, rather than those who simply cannot afford to pay.”
Apart from abolishing cash bail, the SAFE-T Act also prohibits using risk assessment as the sole basis for detention and ensures that the accused are informed of the tool being used. This act was first passed in January 2021, and after some amendments, it was signed by Democratic Governor J.B. Pritzker in December 2022.
However, the implementation of this law was not without its fair share of opposition. The Illinois Supreme Court initially placed a hold on the cash bail provision before finally upholding the law in July. This decision was met with Criticism from the Illinois Fraternal Order of Police (FOP).
“The court failed to listen to the voices of prosecutors from both parties who have warned that the elimination of cash bail could result in dangerous criminals being released back into society, rather than being detained or required to post bail while awaiting trial. This will inevitably lead to more crimes being committed,” stated Chris Southwood, President of the Illinois FOP State Lodge.
Illinois Republican Representative Mary Miller also expressed her concerns with the implementation of the law. In a tweet, she wrote, “The left’s agenda has been to defund the police, refuse to prosecute criminals, and release them from jail. Families deserve safe communities, and victims deserve justice!”
As the first state to eliminate cash bail, Illinois is setting a precedent for others to follow. While advocates applaud this historic move towards criminal justice reform, law enforcement agencies and some politicians fear that it may lead to a rise in crime rates. Only time will tell the true impact of this decision, but one thing is for sure, it has sparked a nationwide conversation surrounding the fairness and efficacy of the cash bail system.
